A new law has been proposed in New Jersey that would allow the confiscation of cellphones after a car accident.
It would allow police to take your cellphone as evidence, if they have reasonable cause to believe that a driver had been talking or texting on the phone before an accident.
Police could then determine if an accident was caused by distracted driving. The bill was proposed by NJ State Senator James Holzapfel, but it’s already being opposed by the American Civil Liberties Union of NJ. The ACLU-NJ says the Constitution requires “probable cause” before a search can be authorized in most cases.
